1. Purpose and acceptance of the Terms of Use

These Terms of Use (hereinafter the "Terms") define the conditions of access to and use of the website www.moncourtierenergie.com (hereinafter the "Site"), as well as the conditions of use of the energy offer comparison services offered online by MON COURTIER ENERGIE GROUPE.

Use of the Site and of the services offered implies acceptance of these Terms.

These Terms may be amended or supplemented at any time, in particular to take account of changes to the Site, to the services offered or to the applicable regulations.

The applicable Terms are those in force on the day the Site or the service is used.

Users of the Site are hereinafter referred to individually or collectively as the "Users" or the "Professional".

2. Access to the Site and general description of the Site and services

The Site is published by MON COURTIER ENERGIE GROUPE, a société anonyme (public limited company) with a share capital of 3,657,862 euros, whose registered office is located at 123 rue Lucien Faure, 33300 Bordeaux, France, registered with the Bordeaux Trade and Companies Register under number 907 898 944.

The contact details and legal information relating to MON COURTIER ENERGIE GROUPE are set out in the Legal Notice, which can be accessed from the Site.

The Site and the online energy offer comparison service are intended exclusively for companies and professionals acting in the course of their professional activity (hereinafter the "Professionals"). The service is not intended for private individuals acting for non-professional purposes.

The Site presents the activities and services of MON COURTIER ENERGIE, in particular its energy brokerage activities.

3. General description of the online energy comparator service

MON COURTIER ENERGIE also offers professionals, on its Site, an online energy supply offer comparison service based on automated processing using artificial intelligence, which makes it possible to analyse their consumption and energy contract data, to search for electricity and/or natural gas supply offers from listed suppliers and to present a comparison of these energy offers.

The service is accessible directly online from the home page, which offers the upload of the invoice.

The comparison service may be carried out in a largely automated manner, in particular by means of artificial intelligence technologies and automated data processing.

MON COURTIER ENERGIE may also, as part of its brokerage activity, assist the Professional with the steps required to compare offers and, where the Professional so wishes, with the preparation of their subscription with the selected supplier.

At the end of the comparison, the professional may select online the energy supply offer of their choice from among the offers presented by the comparator.

Selecting an offer on the site does not constitute acceptance of the offer or subscription to an energy supply contract, and does not bind the professional either towards MCE or towards the energy supplier concerned.

When the professional selects an offer, they may, where applicable, submit online the documents and information requested by the energy supplier so that their file can be completed and processed.

The list of documents requested is determined by the energy supplier and may vary depending on the professional's situation and the characteristics of the file. Submitting these documents does not constitute subscription to a supply contract either.

The energy supply contract is concluded directly between the professional and the energy supplier, in accordance with the subscription procedures implemented by the latter. The contract is signed outside the website www.moncourtierenergie.com and is the stage at which the professional formalises their contractual commitment to the supplier.

Presentation of the savings achieved by clients:

As part of the comparator, MON COURTIER ENERGIE may display a percentage of savings achieved by its clients.

The savings percentage displayed corresponds to the savings actually achieved by MON COURTIER ENERGIE clients on energy contracts signed during the year 2025, calculated by comparison with their reference supply contract and for clients operating in the same business sector or in a business sector comparable to that of the Professional. Sector comparability is determined on the basis of a grouping of APE codes according to their sector proximity.

Where the number of clients for a grouping of APE codes by sector proximity or the available data are not sufficiently representative to allow a relevant indicator to be presented, MON COURTIER ENERGIE may, in order not to present information that could be misleading, use the savings percentage observed across all of its clients, all business sectors combined. The Professional will find all the information relating to these calculations at the bottom of the page.

These percentages are historical and statistical data. They do not constitute a personalised estimate, a forecast or a guarantee of savings for the Professional on their own invoice.

The savings that the Professional may actually achieve depend in particular on their contractual situation, their consumption, their supply characteristics, the subscription period and the offers available at the time of their request.

Consequently, the savings percentage presented in the comparator does not relate to the Professional's invoice and cannot be regarded as a guaranteed saving or as a commitment by MON COURTIER ENERGIE as to the level of savings that will actually be achieved by the Professional.

It is also specified that, unless otherwise indicated, any response times mentioned in the online comparison process, in particular those relating to contacting the Professional, are given for information purposes only and do not constitute a firm commitment on the part of MON COURTIER ENERGIE, which will use its best efforts to comply with them.

3.1 Submission of the invoice and of the information required by the comparator

In order to use the comparison service, the professional may be asked to submit one or more energy invoices and, where applicable, any information or document required to analyse their situation and compare offers.

The information that may be used includes in particular, depending on the information available:

the identity and contact details of the company;
the identity and contact details of the company's representative;
the references of the site(s) concerned;
the delivery point or metering point references, in particular PDL or PCE;
the supplier's references;
consumption data;
the subscribed power;
the characteristics of the current contract;
pricing data;
consumption periods;
information relating to the contract's deadlines and term;
as well as any other data required to identify the professional's needs and to compare offers.

The professional warrants that the information and documents submitted are accurate, complete and up to date, and that they hold the rights, authorisations and powers required to submit these documents and allow their use as part of the service.

Where the invoice or the documents submitted contain data relating to third parties, the professional undertakes to hold the authorisations required for their submission.

MON COURTIER ENERGIE cannot be held liable for the consequences of inaccurate, incomplete, outdated, illegible or irrelevant information submitted by the Professional.

It is recommended to submit the most recent invoice received in order to have the most up-to-date view of the information.

3.2 Automated reading and analysis of invoices by artificial intelligence

Use of artificial intelligence and automated processing technologies

As part of the service, MON COURTIER ENERGIE uses artificial intelligence technologies and/or other automated processing technologies in order, in particular, to facilitate the reading, extraction, processing and analysis of the information contained in the invoices and documents submitted by the Professional.

These technologies may in particular make it possible to:

identify the relevant information on an invoice or in the documents submitted;
automatically extract certain data;
reconcile and analyse this data;
identify certain characteristics of the contract and of energy consumption;
determine the information required to compare offers;
pre-fill certain forms or documents required for the comparison process;
query or facilitate exchanges with energy suppliers;
process the information required to present and rank offers according to the criteria defined for the comparator.

AI processing and automated processing may contain errors or omissions, depending in particular on the quality, format, legibility or content of the documents submitted.

The Professional is invited to check the extracted or pre-filled information before using it, in particular where it is intended to be sent to an energy supplier or to appear in a contractual document.

Where the process allows, the Professional may correct or supplement the extracted information before it is sent.

To allow their situation to be analysed and the comparison to be carried out, the Professional submits an energy invoice online.

Where the invoice submitted is insufficiently legible, incomplete or does not make it possible to identify the Professional's pricing or consumption characteristics with sufficient precision, MON COURTIER ENERGIE may ask them to submit an additional invoice.

An additional invoice may in particular be requested for the same delivery point where the Professional has a tariff comprising distinct consumption periods, in particular summer hours / winter hours periods or pricing arrangements that vary by period of the year, in order to obtain the information required for a more precise comparison of offers.

The Professional is invited to submit a 2nd invoice for their delivery point covering a period sufficiently distant from that covered by the first invoice, in order to allow a more representative analysis of their consumption and to better take account of any seasonal variations.

Submitting this additional invoice makes it possible in particular to refine the estimate of the Professional's annual consumption and, consequently, the estimate of their annual energy budget in relation to the offers proposed.

This second invoice is particularly important if the Professional is subject to seasonality.

If the second invoice is not submitted, the online comparison process may nevertheless continue. However, the budget analysis presented on the basis of the available offers will be drawn up using only the consumption data available and may therefore not be fully representative of the Professional's actual annual consumption, in particular in the event of seasonal variations.

The results presented, in particular the estimate of the annual energy budget, must be regarded as indicative. MON COURTIER ENERGIE may, where applicable, contact the Professional again in order to collect the additional information required and, where applicable, refine the analysis of their situation with them, in particular through MON COURTIER ENERGIE or one of its local agencies.

MON COURTIER ENERGIE cannot be held liable for the consequences of missing or incorrect information contained in a document submitted by the Professional, or of incorrectly extracted data where this information was not checked or corrected by the Professional although they were given the opportunity to do so.

The terms governing the processing of personal data in connection with the use of artificial intelligence and automated processing technologies are set out in the Privacy Policy.

3.3 Verification and enrichment of the professional's information

As part of the comparison process, MON COURTIER ENERGIE may verify and enrich the information provided by the professional by querying external databases and information sources accessible in the course of its activity, in particular in order to identify or verify information relating to the professional, their establishment and their legal representative(s).

These checks may in particular cover the identification of the Professional, their SIREN, their SIRET, their company name, their contact details and their legal representative. MON COURTIER ENERGIE also verifies the PDL / PCE data.

To this end, MON COURTIER ENERGIE may in particular use the services of specialised providers giving access to information on companies and their representatives. The information thus obtained may be used to facilitate and secure the comparison process, pre-fill certain forms or documents, verify the information provided by the professional and prepare the necessary steps with the network operators and energy suppliers.

The professional remains responsible for the accuracy of the information they provide and must check, correct or supplement, where given the opportunity, the information thus pre-filled before it is validated or sent.

The terms governing the processing of personal data in this context, in particular the data sources, the categories of data concerned, the purposes pursued, the recipients, the retention periods and the processors, are set out in the Privacy Policy.

3.4 Vigilance regarding the end date of the current contract

The contract end date displayed in the comparator may in particular come from the information on the invoice you submitted, from data retrieved from it, or may be entered directly by you. You must carefully check the accuracy of this date before continuing.

This date may correspond to the effective date of the new supply contract that you could subscribe to if you decided to validate an offer at the end of the comparison process. It is therefore your responsibility to ensure that, on that date, you will no longer be bound by your current supply contract or by any other contract relating to the same delivery point.

The comparator cannot replace this check. You are invited to consult your current supply contract and, where applicable, to contact your current supplier in order to verify the actual end date of your commitment and any conditions applicable to its termination or renewal.

Validating an offer at the end of the process is your sole decision and assumes that you have first checked that the effective date of the new contract is compatible with the end of your commitment to your current supplier.

3.5 Authorisation to collect and transmit energy data

To enable the comparison service to operate, the professional is invited to complete and validate online an authorisation to collect and transmit their energy data ("ACD").

This authorisation allows MON COURTIER ENERGIE and its partner brokers, under the conditions and for the purposes defined therein, to access from the network operators concerned the consumption data and other energy data required to process the professional's request, and then to use it and transmit it to the energy suppliers consulted so that energy supply offers can be drawn up and presented.

The ACD specifies in particular the purposes of the collection and use of the data, its period of validity and the terms applicable to its retention. Unless otherwise stipulated in the ACD, it is valid for a period of thirty-six (36) months from its validation, in particular to allow the monitoring and, where applicable, the renewal of the supply contracts concluded following the comparison. It will, however, be retained for 5 years for evidentiary purposes in the event of a complaint, request or audit, in particular from the energy supplier or the network operator.

Validation of the ACD does not entail subscription to any energy supply offer and does not oblige the professional to enter into a contract with a supplier.

The person who validates the ACD on behalf of the professional declares that they have the capacity and powers required to represent and bind the professional for this purpose. They must, in this respect, be its legal representative or hold a power of attorney authorising them to carry out this step in the name and on behalf of the professional.

MON COURTIER ENERGIE may request, at any time, proof of these powers. The person who validated the ACD undertakes to provide this proof as soon as possible upon request from MON COURTIER ENERGIE or, where applicable, from the network operator or the energy supplier concerned.

The professional warrants the accuracy of the information provided and undertakes to inform MON COURTIER ENERGIE of any change affecting the powers of the person who validated the ACD.

The professional will receive a summary of their ACD by email.

3.6 How the online energy offer comparator works

The process on the site allows the professional to compare energy supply offers proposed by partner energy suppliers likely to meet their request.

To enable the online comparator to operate, MON COURTIER ENERGIE has selected, from among its partner suppliers, a panel of suppliers able to process comparison requests as part of the digital process and within a timeframe compatible with it. The offers presented depend in particular on the suppliers and offers available at the time of the request.

On the basis of the information provided by the Professional, in particular the information extracted from the energy invoice submitted and, where applicable, the energy data collected under the Data Collection Authorisation, MON COURTIER ENERGIE queries, via the site, the available energy suppliers in order to collect the offers likely to match the Professional's situation and consumption characteristics.

The offers received are then presented to the Professional and ranked in ascending order on the basis of the annual budget excluding VAT (corresponding to the price per megawatt-hour multiplied by the consumption volume retrieved from the network operator), so as to allow a comparison with the pricing characteristics on their energy invoice and the data retrieved from the network operators. This energy budget excluding VAT includes transmission and taxes. It is specified that the energy price expressed in euros per megawatt-hour (€/MWh) used to calculate the annual budget excluding VAT includes the volume-weighted average price by time-of-use and seasonal period. A details link gives access to additional information provided by the energy suppliers.

The energy budget excluding VAT presented is an estimate calculated on an identical consumption basis for all the different offers, using the consumption data available. Where the available data do not sufficiently take into account seasonal variations in consumption, in particular in the absence of a second invoice covering a period sufficiently distant from the first, the reference annual consumption used for the calculation may not be representative of the Professional's actual annual consumption. The energy budget excluding VAT presented may then differ from the budget that would result from their actual annual consumption.

It is specified that the energy price presented to the professional in the comparator, expressed in euros per megawatt-hour (€/MWh), includes the remuneration of MON COURTIER ENERGIE for its brokerage activity. This remuneration is paid directly to MON COURTIER ENERGIE by the energy supplier and is not invoiced separately to the professional.

The comparator is based on the offers actually obtained from the suppliers consulted and does not constitute an exhaustive comparison of all the offers available on the market or of all of MON COURTIER ENERGIE's partner suppliers. The number of suppliers consulted and the offers that may be presented may vary depending in particular on the professional's characteristics, their consumption profile, the time of consultation and the availability of suppliers.

MON COURTIER ENERGIE uses its best efforts to present the Professional, where the conditions of the file allow, with several offers from partner suppliers likely to meet their request.

However, the number of offers available may be fewer than three (3), in particular where no offer matches the Professional's characteristics or consumption, where the suppliers consulted are unable to propose an offer online, or where the characteristics or complexity of the file do not allow an online comparison.

In these situations, the Professional may be contacted again by MON COURTIER ENERGIE or, where applicable, by one of its local agencies, in order to continue the analysis of their request and, where possible, search for offers suited to their situation.

The presentation and ranking of offers are intended to facilitate the comparison of the proposals received. The Professional remains free to select or not one of the offers presented.

3.7 Period of validity of the comparator's offers

The energy supply offers presented in the comparator are proposed subject to availability and for a set period of validity, indicated in the comparator or in the information provided with the offer.

On expiry of this period of validity, the offer presented is no longer considered valid and its pricing and contractual conditions may no longer apply. The prices and conditions displayed in the comparator may therefore change after that date.

If the Professional wishes to obtain a new comparison after an offer has expired, they may generate a new comparison request from the comparator or contact MCE's customer service in order to check the offers and conditions then available.

Selecting an offer in the comparator does not, in itself, constitute the conclusion of an energy supply contract. The conclusion of the contract is subject to the subscription conditions and procedures of the supplier concerned.

3.8 Selection of an offer and completion of the file

At the end of the comparison, the professional may select online the energy supply offer of their choice from among the offers presented by the comparator.

Selecting an offer on the site does not constitute acceptance of the offer or subscription to an energy supply contract, and does not bind the Professional towards the energy supplier concerned.

When the Professional selects an offer, they may, where applicable, submit online the documents and information requested by the energy supplier so that their file can be completed and processed.

The list of documents requested is determined by the energy supplier and may vary depending on the Professional's situation and the characteristics of the file. Submitting these documents does not constitute subscription to a supply contract either.

The energy supply contract is concluded directly between the Professional and the energy supplier, in accordance with the subscription procedures implemented by the latter. The contract is signed outside the website www.moncourtierenergie.com and is the stage at which the Professional formalises their contractual commitment to the supplier.

3.9 Next steps if an offer is selected

At the end of the comparison process, if you select an energy supply offer, MCE takes over in order to verify the information required to build your file and to pursue your subscription request.

To this end, MCE may contact you again to verify the details entered during the process and, where applicable, ask you for any additional document or information required to finalise your file.

Before any subscription, the pre-contractual information, the general terms and conditions of sale and, more generally, the contractual documents applicable to the selected offer will be provided to you, in accordance with the procedures set by the supplier concerned.

Selecting an offer in the comparator does not, in itself, constitute the conclusion of an energy supply contract. Final subscription takes place in accordance with the procedures set by the supplier and after completion of the required formalities.

3.10 Abandoning the process and resuming later

Where the professional interrupts their comparison process after submitting their invoice or after validating a Data Collection Authorisation ("ACD"), MON COURTIER ENERGIE may, in particular through its network of broker agencies and under the conditions set out in its Privacy Policy, retain the information and documents submitted in order to be able to contact the professional again and allow them, where applicable, to continue or resume their comparison process.

After validation of the ACD, the information required to follow up the process may in particular be recorded in MON COURTIER ENERGIE's customer relationship management (CRM) system. The professional may then receive by email a link allowing them to access their process again and continue the steps already begun.

The link allowing the process to be resumed is valid for seven (7) days from the date it is issued. After this period, the link is no longer accessible and a new link may, where applicable, be sent to the professional.

The retention period for the data and documents submitted as part of the process, in particular the invoice and the data required to follow up the relationship with the professional, is determined in accordance with the periods and purposes set out in the Privacy Policy. Where the ACD has been validated, it is in particular retained for a period of 5 years, under the conditions set out therein, in order in particular to allow the monitoring of the supply contract and, where applicable, the search for new offers or the renewal of the contract, and for evidentiary purposes at the request of suppliers.

The professional may exercise their rights, in particular their right to object where applicable, under the conditions set out in the Privacy Policy.

4. Service availability and interruptions - Liability

MON COURTIER ENERGIE uses the reasonable means required to ensure the accessibility and proper functioning of the comparator. However, the comparator is accessed through a telecommunications network and computer systems, not all of whose components are under MCE's control.

MON COURTIER ENERGIE cannot be held liable for difficulties or inability to access the comparator resulting in particular from a failure, interruption, slowdown or unavailability of the Internet network, the telecommunications network, the hardware or equipment used by the User, their Internet service provider, or any event beyond MCE's control.

Nor can MON COURTIER ENERGIE be held liable for temporary interruptions, slowdowns or malfunctions of the comparator resulting in particular from maintenance operations, updates, technical developments, measures required for the security of the service or, more generally, circumstances beyond its control. MON COURTIER ENERGIE will endeavour to restore the operation of the comparator as soon as possible, without this obligation being interpreted as a guarantee of permanent or uninterrupted availability of the service.

In any event, this clause shall not have the effect of limiting or excluding MCE's liability in cases where such limitation or exclusion is prohibited by law.

With regard to the operation of the online comparator, MON COURTIER ENERGIE implements reasonable measures to ensure the quality and reliability of the processing used in the comparator. If an anomaly likely to affect the results presented is identified, MON COURTIER ENERGIE takes the appropriate measures to correct it and, where applicable, to carry out a new analysis.

MON COURTIER ENERGIE cannot be held liable solely on the basis of an error, omission or inaccuracy resulting from the data provided by the User, the documents submitted, their quality or automated processing, where MON COURTIER ENERGIE has used the reasonable means at its disposal to ensure the operation of the service.

The decision to subscribe to an offer rests exclusively with the User, who remains responsible for verifying the information concerning them and its consistency with their contractual situation before any subscription.

MON COURTIER ENERGIE cannot be held liable for the content of the energy suppliers' offers or for their contractual terms.

Management of personal data and cookies:

When using the website www.moncourtierenergie.com, data may be collected, such as the URL of the links through which the User accessed the website www.moncourtierenergie.com, the User's Internet service provider or the User's Internet Protocol (IP) address, or personal data when the User fills in forms on the site.

In any event, MON COURTIER ENERGIE only collects personal information relating to the User for the purposes of the services offered on the website www.moncourtierenergie.com and for the energy offer comparison request. The User provides this information knowingly, in particular when they enter it themselves. The User of the website is then informed whether or not they are required to provide this information. Before submitting their personal data, the User has access to the privacy policy available on the website.

The collection and processing of personal data on this site are carried out in accordance with MON COURTIER ENERGIE's Privacy Policy, which can be accessed at any time at the bottom of this page of the website. By using the site, the Professional accepts the conditions set out in this policy, which describes how their personal data is collected, used and protected.

COOKIES

A cookie is a computer file stored on the hard drive of the User's computer which indicates that they have visited the website.

As part of the online comparator process, the User's information is not stored in a cookie.

Session

The online comparison process does not set any cookie of its own. To allow the process to continue from one screen to the next, certain information is temporarily stored in the browser's session storage (SessionStorage). This session stores the file identifier, the progress of the process and the information entered (company, signatory, sites, current contract).

This session is deleted when the tab is closed, but the data submitted at this stage of the process is retained for 7 days to allow the User to resume the process via a link opening a new session (sent by email).

When the ACD is validated, a technical fingerprint of the browser is computed locally for the purpose of evidencing consent.

Any trackers and audience measurement tools present on the Site are described in the Privacy Policy.

The User acknowledges that MON COURTIER ENERGIE does not authorise them to create and/or maintain a link to its website without its express prior consent.

Applicable law and jurisdiction:

Any dispute relating to the use of the website www.moncourtierenergie.com is subject to French law. Exclusive jurisdiction is granted to the competent courts.
